1. ABOUT THESE TERMS

These Terms of Service (“Terms”) govern your access to and use of the Zibarco website, including its content, product-discovery tools, comparisons, recommendations, search features, guides and outbound links (collectively, the “Website”).

The Website is operated under the trade name Zibarco by CREȚU PAULIAN ÎNTREPRINDERE INDIVIDUALĂ, established in Sibiu, Romania (“Zibarco”, “we”, “us” or “our”).

By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

2. NATURE OF ZIBARCO

Zibarco is an independent product-discovery, comparison and affiliate website.

Zibarco does not:

- sell products directly;
- accept or fulfil product orders;
- process payments;
- maintain customer purchasing accounts;
- ship or deliver products;
- provide product warranties;
- accept product returns;
- issue product refunds.

Products displayed on the Website are offered and sold by third-party retailers, including Amazon and sellers operating through Amazon.

3. AFFILIATE RELATIONSHIP

Zibarco participates in affiliate programmes, including the Amazon Associates Programme.

As an Amazon Associate I earn from qualifying purchases.

When you select certain product links, Zibarco may earn a commission if you complete a qualifying action or purchase. This does not normally increase the price you pay.

Affiliate compensation does not make Zibarco the seller, manufacturer, importer, distributor or contractual party to a product purchase.

Amazon OneLink or similar technology may redirect you to an Amazon marketplace appropriate to your location. The availability of redirection, product matching and commission attribution is controlled by Amazon and is not guaranteed by Zibarco.

Zibarco is not sponsored, endorsed by, administered by or officially affiliated with Amazon except through participation in the applicable affiliate programme.

4. THIRD-PARTY PURCHASES

When you select a product link, you leave Zibarco and may be redirected to Amazon or another independently operated website.

Any purchase is completed directly with the relevant retailer or third-party seller. The retailer’s terms, privacy policy, prices, availability, payment procedures, delivery conditions, warranties, return rules and refund procedures apply to the transaction.

Zibarco is not a party to that transaction and cannot:

- accept, reject, cancel or modify an order;
- charge or refund a payment;
- access or manage your retailer account;
- arrange or alter delivery;
- authorise a return or replacement;
- resolve a warranty or customer-service claim.

Questions concerning a transaction must be directed to the retailer or seller through whom the purchase was completed.

5. PRODUCT INFORMATION, PRICES AND AVAILABILITY

Zibarco may display product titles, descriptions, images, specifications, ratings, availability, prices, comparisons or other information obtained from retailers, manufacturers, publicly available sources, automated imports or editorial research.

We aim to present useful and accurate information, but product information may be incomplete, delayed, translated, automatically imported or changed by a third party without notice.

The definitive product description, seller identity, price, currency, taxes, delivery costs, stock status and purchase conditions are those displayed by the retailer at the time of purchase.

A product’s appearance, colour, dimensions, accessories or packaging may differ from images or descriptions displayed on Zibarco. You should verify all important information on the retailer’s website before purchasing.

Zibarco may add, remove, reorganise or update products and content at any time without notice.

6. EDITORIAL CONTENT AND COMPARISONS

Product selections, comparisons, guides, rankings and descriptions are provided for general informational and product-discovery purposes.

They do not constitute professional, medical, legal, financial, safety or technical advice. They are not a guarantee that a product is suitable for every person, purpose, location or circumstance.

Terms such as “best”, “recommended”, “top”, “smart”, “safe”, “useful” or similar expressions reflect editorial categorisation or product-discovery criteria and should not be understood as an absolute guarantee.

You remain responsible for evaluating a product and reviewing the retailer’s information, instructions, warnings, age restrictions and safety requirements before purchasing or using it.

7. SHIPPING, RETURNS, REFUNDS AND WARRANTIES

Zibarco does not ship products or control delivery estimates.

Shipping, customs, import charges, delivery, risk of loss, returns, replacements, refunds and warranties are administered by the relevant retailer or seller under its own policies and applicable law.

Zibarco cannot determine whether a purchase qualifies for a return, refund, replacement or warranty service.

Nothing in these Terms limits any mandatory consumer rights you may have against the actual retailer or seller under applicable law.

8. ACCESS TO THE WEBSITE

You may use the Website only for lawful, personal or legitimate business-information purposes and in accordance with these Terms.

You are responsible for ensuring that your device, browser, internet connection and security settings are suitable for accessing the Website.

We may modify, suspend, restrict or discontinue any part of the Website where reasonably necessary for maintenance, security, legal compliance, technical changes or business reasons.

We do not guarantee that every feature, product link, third-party page or localisation service will always be available or error-free.

9. ACCOUNTS AND PAYMENT INFORMATION

Zibarco does not provide customer purchasing accounts and does not ask visitors to submit payment-card information for product purchases.

Do not send passwords, payment-card information, identity documents or other sensitive information through Zibarco’s contact channels.

Accounts, payments and order information submitted to Amazon or another retailer are controlled by that third party under its own terms and privacy policy.

10. INTELLECTUAL PROPERTY

The Zibarco name, original website design, original written content, selection and arrangement of content, custom graphics and other original materials created by Zibarco are protected by applicable intellectual-property laws.

Product names, trademarks, logos, images, descriptions and other materials belonging to Amazon, manufacturers, sellers or other third parties remain the property of their respective owners and may be displayed under licence, affiliate-program permissions or other lawful grounds.

You may access the Website for personal and non-commercial use. Except where permitted by law, you may not reproduce, republish, distribute, sell, systematically extract, modify or commercially exploit substantial parts of the Website without prior written permission from the relevant rights holder.

No provision of these Terms transfers ownership of any intellectual-property right to you.

11. USER COMMUNICATIONS AND FEEDBACK

When you contact Zibarco, you are responsible for ensuring that your message is lawful, accurate and does not infringe another person’s rights.

You must not send malicious code, unlawful content, confidential information belonging to another person, spam or misleading communications.

If you voluntarily provide suggestions or feedback about the Website, you grant Zibarco a non-exclusive, worldwide, royalty-free right to use that feedback to operate, improve and promote the Website. This does not transfer ownership of personal information or confidential material.

12. PROHIBITED USE

You must not use the Website to:

- violate applicable law or another person’s rights;
- introduce malware, malicious scripts or harmful code;
- attempt unauthorised access to the Website, Shopify systems or connected services;
- interfere with security, availability or normal operation;
- impersonate another person or misrepresent your identity;

The Website is hosted by Shopify and may use services supplied by Shopify, Amazon, analytics providers, advertising platforms and other technical providers.

Shopify provides the website platform but is not the seller of products promoted through Zibarco and is not a party to purchases completed on Amazon or another retailer’s website.

Third-party websites and services are independently operated. Zibarco does not control and is not responsible for their availability, security, content, privacy practices, commercial terms or actions.

A link does not constitute a guarantee or endorsement of every statement, product or service available on the linked website.

14. PRIVACY AND COOKIES

Zibarco processes personal information as described in its Privacy Policy, linked in the Website footer.

The Website may use essential cookies and, subject to applicable consent requirements, analytics, advertising, conversion-measurement and affiliate-attribution technologies.

Third-party retailers process information collected after you leave Zibarco under their own privacy policies.

15. WEBSITE SECURITY

We use reasonable measures intended to protect the Website, but no online service can be guaranteed to be completely secure, uninterrupted or free from harmful components.

You are responsible for maintaining reasonable device security and for checking that a link has directed you to the retailer and domain you intended to visit before entering account, payment or personal information.

Nothing in these Terms limits your rights against the retailer, seller, manufacturer or another responsible party.

18. INDEMNITY FOR UNLAWFUL USE

To the extent permitted by law, you are responsible for reasonably foreseeable losses suffered by Zibarco as a direct result of your deliberate unlawful use of the Website, infringement of third-party rights or introduction of malicious code.

This section does not require a consumer to compensate Zibarco for losses caused by Zibarco or for matters for which liability cannot lawfully be transferred.

19. SUSPENSION AND TERMINATION

We may restrict or terminate access to the Website where reasonably necessary because of unlawful use, security threats, abuse, interference with the Website or repeated material breach of these Terms.

Provisions concerning intellectual property, liability, governing law and matters that by their nature should continue will survive termination.

We may update the Website and these Terms to reflect legal, technical, operational or business changes.

The current version will be published on this page with an updated revision date. Material changes will apply from the date stated in the updated Terms or any notice required by applicable law.

If any provision of these Terms is held to be unlawful or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply.

A failure to enforce a provision on one occasion does not waive the right to enforce it later.

They do not govern the separate purchase agreement between you and a third-party retailer or seller.

These Terms are governed by Romanian law.

The competent courts will be determined under applicable Romanian and European Union law.

If you are a consumer residing in another country, nothing in these Terms deprives you of mandatory protections or jurisdictional rights available under the law applicable to you.
